- Consent — proving that personal data used to generate personalised content was collected with appropriate consent.

Retention limits for customer data used in AI training
PDPA's Retention Limitation Obligation requires that personal data not be retained longer than necessary for the purpose. AI introduces a complication: data that has been used to fine-tune or otherwise train a model is, in practice, embedded in the model.
The compliant architecture for marketing AI in 2026:
- No tenant data is used to train shared base models. Per-tenant configurations only.
- Retrieval-augmented generation (RAG) instead of fine-tuning for tenant-specific customisation. The AI retrieves from your data live; your data is not embedded in the weights.
- Documented retention windows per data class. Behavioural events: 24 months. Identity records: contract duration + 12 months. Marketing engagement: 36 months. Each documented in the DPA.
- Customer right-to-erasure must propagate. When a customer requests deletion under PDPA, the deletion must reach all places the data has been replicated — including any embedding indices.
Auditing your marketing AI stack for PDPA compliance
A practical audit takes a half-day with the right people in the room. Use this question set:
- Map the data flow. What personal data leaves your CRM, what goes to the AI, what comes back, what is retained where? Diagram it.
- Verify the consent linkage. Withdraw consent for a test customer. Time how long until the AI stops using their data. The answer must be near-real-time.
- Confirm purpose limitation. Pick one personal data field. Trace every AI use of it. Confirm each falls within the consented purpose.
- Inspect the DPA. Sub-processor list, residency, retention, breach notification SLAs, audit rights. All present and current.
- Test the right-to-erasure flow. Issue a deletion request through your normal channel. Verify it propagates to the AI's working dataset and any derived stores.
- Review the audit log. The AI's decision log should capture: what data it accessed, what it generated, who approved the output. 12 months minimum retention.
- Confirm the breach notification path. If the AI vendor has a breach affecting your tenant data, who calls whom, in what window?
- Document the DPO's review. The compliance posture must be reviewed annually by your DPO and signed off in writing.
Penalties for non-compliance
The PDPA's enforcement track has been getting heavier. The 2022 amendment raised maximum financial penalties to 10% of annual turnover in Singapore for organisations with annual turnover above S$10 million, capped at S$1 million for smaller organisations. The PDPC has used both ceilings.
For AI marketing specifically, three failure modes account for most public enforcement decisions:
- Failure of consent. Personal data used for marketing without active, scope-appropriate consent.
- Failure of protection. A breach where personal data was inadequately secured — typically because access controls were broader than necessary.
- Failure of accountability. Inability to produce documentation on demand — the data flow, the consent records, the DPA, the audit log.
